\u00e7\u0131kar\u0131lmas\u0131 durumunda ortaya \u00e7\u0131kar.\u00a0T\u00fcrk Hukuk sistemine g\u00f6re, \u00e7al\u0131\u015fanlar \u0131rk, cinsiyet, din, engellilik veya ya\u015f temelinde ayr\u0131mc\u0131l\u0131\u011fa maruz b\u0131rak\u0131lamaz.\u00a0Bunu yapan i\u015fverenler, haks\u0131z yere fesihten dolay\u0131 hukuki sorumlulu\u011fa tabi olabilirler.<\/p>\n<p (\u0130\u015f\u00e7i hakl\u0131ysa, i\u015fe iade karar\u0131 \u00e7\u0131kar. Normalde i\u015fveren i\u015f\u00e7iyi bir ay i\u00e7inde i\u015fe ba\u015flatmak zorundad\u0131r fakat daval\u0131k olduklar\u0131 i\u00e7in i\u015fveren mahkeme karar\u0131na ra\u011fmen i\u015f\u00e7iyi ba\u015flatmayabilir. Bu durumda tazminat \u00f6der.<\/p>\n<p class=\"font_8\">3-)TAZM\u0130NAT:\u00a0\u0130\u015f\u00e7iyi, ba\u015fvurusu \u00fczerine i\u015fveren bir ay i\u00e7inde i\u015fe ba\u015flatmaz ise i\u015f\u00e7iye en az 4 ve en fazla 8 ayl\u0131k \u00fccreti tutar\u0131nda tazminat\u00a0 \u00f6demekle y\u00fck\u00fcml\u00fc olur.<\/p>\n<p class=\"font_8\">4-)\u00dcCRET \u00d6DEMES\u0130:\u00a0Karar\u0131n kesinle\u015fmesine kadar \u00e7al\u0131\u015ft\u0131r\u0131lmad\u0131\u011f\u0131 s\u00fcre i\u00e7in i\u015f\u00e7iye en \u00e7ok 4 aya kadar do\u011fmu\u015f bulunan \u00fccret ve di\u011fer haklar\u0131 \u00f6denir.<\/p>\n<ul class=\"font_8\">\n<li>\n<p class=\"font_8\">Tazminat ve 4 aya kadar olan \u00fccretin ikisi de \u00f6denir. Bunlar, i\u015f\u00e7inin u\u011frad\u0131\u011f\u0131 zararlardan dolay\u0131 i\u015fverene Bor\u00e7lar Kanunu\u2019nca maddi &#8211; manevi tazminat davas\u0131 a\u00e7mas\u0131na engel de\u011fildir.<\/p>\n<\/li>\n<\/ul>\n<p class=\"font_8\">\u0130\u015e KAZALARI SONRASI DESTEKTEN YOKSUN KALMA TAZM\u0130NATI (MADD\u0130-MANEV\u0130 TAZM\u0130NAT DAVASI)<\/p>\n<p class=\"font_8\">Bir i\u015f kazas\u0131nda sorumlu kimdir? \u0130\u015f kazas\u0131nda birden \u00e7ok taraf vard\u0131r: \u0130\u015fveren, i\u015f\u00e7i, ve 3. Buna ili\u015fkin hukuksal prosed\u00fcr\u00fcn i\u015fledi\u011fi davalara hizmet tespit davalar\u0131 denir.<\/p>\n<p class=\"font_8\">Hizmet Tespiti Ne Demektir?<\/p>\n<p class=\"font_8\">Sigortal\u0131lar taraf\u0131ndan\u00a0iki t\u00fcr hizmet tespit davas\u0131\u00a0a\u00e7\u0131labilir: Birincisi, bir i\u015fyerinde bir i\u015fverene ba\u011fl\u0131 olarak ne kadar s\u00fcre \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131n\u0131n tespit edilmesi amac\u0131yla a\u00e7\u0131lan hizmet tespit davalar\u0131d\u0131r.<\/p>\n<p class=\"font_8\">\u0130kinci t\u00fcr hizmet tespit davas\u0131: Ki\u015fi \u00e7al\u0131\u015fm\u0131\u015ft\u0131r ve i\u015fvereni taraf\u0131ndan sigortas\u0131 yap\u0131lm\u0131\u015ft\u0131r ancak i\u015fveren, sigortal\u0131y\u0131 eksik \u00fccretten\/matrahtan veya eksik primle SGK\u2019ya bildirmi\u015ftir. Eksik prim derken; \u00d6rne\u011fin adam ayda 30 g\u00fcn \u00e7al\u0131\u015fm\u0131\u015f fakat 20 g\u00fcn \u00fczerinden bildirilmi\u015ftir. B\u00f6yle bir durumda i\u015f\u00e7i hizmet tespit davas\u0131nda, eksik kalan g\u00fcnlerinin tespitini isteyecektir. Ya da matrah\u0131 eksik bildirilmi\u015ftir: Mesela adam 4000 TL \u00fccretle \u00e7al\u0131\u015f\u0131yordur fakat i\u015fveren onu asgari \u00fccretten bildirmi\u015ftir. Bu durumda da hizmet tespit davas\u0131 a\u00e7\u0131labilir,i\u015f\u00e7i hizmet tespit davas\u0131 a\u00e7arak hakk\u0131n\u0131 arayabilir.<\/p>\n<p class=\"font_8\">\u0130\u015e HUKUKU NED\u0130R ?<\/p>\n<p class=\"font_8\">Her \u015feyden \u00f6nce 4857 say\u0131l\u0131 i\u015f K&#8217;nin amac\u0131, i\u015fverenler ile bir i\u015f s\u00f6zle\u015fmesine dayanarak \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7ilerin \u00e7al\u0131\u015fma \u015fartlar\u0131 ve \u00e7al\u0131\u015fma ortam\u0131na ili\u015fkin hak ve sorumluluklar\u0131n\u0131 d\u00fczenlemektir&#8221; (i\u015f K. 1\/1) bi\u00e7iminde dile getirilmi\u015ftir. Bu ba\u011flamda denilebilir ki; 4857 say\u0131l\u0131 i\u015f K&#8217;n\u0131n amac\u0131 i\u015f\u00e7ilerle i\u015fverenler aras\u0131ndaki bireysel i\u015f hukukuna ait konular\u0131 d\u00fczenlemektir. Ger\u00e7ekten de yasan\u0131n i\u015f\u00e7i\/i\u015fveren\/alt i\u015fveren\/i\u015fveren vekili vs. gibi kavramlar yan\u0131nda i\u015f ili\u015fkisi\/hizmet s\u00f6zle\u015fmesi ve t\u00fcrlerini, bu ili\u015fkinin kurulu\u015fu i\u015fleyi\u015fi ve sona ermesini, hatta sona ermenin kimi sonu\u00e7lar\u0131n\u0131 d\u00fczenledi\u011fi g\u00f6r\u00fcl\u00fcr.
